Welcome to the Terp Party website (“Site”). These Terms & Conditions (“Terms”) apply to all purchases, orders, and use of any products or services offered through this Site. By accessing the Site or placing an order, you agree to be bound by these Terms.

If you do not agree, do not use this Site or purchase any products from Terp Party.

 

1) Agreement to Terms

These Terms form a binding agreement between you (“Buyer,” “you,” or “customer”) and Terp Party (“Terp Party,” “we,” “us,” or “Seller”). These Terms apply to every sale, invoice, shipment, and transaction unless an authorized Terp Party representative provides a written agreement signed by Terp Party that specifically replaces or modifies these Terms.

 

2) Intended Use / Compliance With Law

Terp Party products are intended only for lawful, responsible adult use where permitted. Our products are designed for use with items such as pipe tobacco, cigars, cigar wraps, shisha/hookah mixtures, legal dried herbs, water pipe/hookah water, vaporizers, and similar lawful applications.

Terp Party products may not be used for any unlawful purpose, and must not be used in connection with illegal manufacturing, prohibited substances, or activity restricted by local, state, or federal law. You are solely responsible for ensuring your purchase and use complies with all applicable laws and regulations in your jurisdiction.

 

3) Product Information & No Medical Claims

All product descriptions and content provided on the Site are informational only. Nothing on this Site is intended as medical advice, or as a substitute for professional guidance.

Terp Party products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Individual experiences and results may vary.

 

4) Product Supply / Manufacturing Disclosure

Terp Party does not manufacture the products sold on this Site. Terp Party sources products from third-party suppliers and/or manufacturers. Product availability, packaging, and specifications may change without notice, subject to supplier availability and updates.

 

5) Payment Authorization

To help prevent fraud and unauthorized transactions, Terp Party may require a signed credit card authorization form and/or identity verification before an order is processed or shipped. Orders may be delayed or canceled if required verification is not completed.

 

6) Sales Final / Returns & Exchanges

All sales are final. Terp Party does not accept returns and does not offer refunds.

Exchanges, if approved by Terp Party in writing, may be subject to a restocking fee of up to 20% and must comply with any exchange conditions provided at the time of approval. Certain items, including bulk items or discounted items, may not be eligible for exchange.

 

7) Risk of Use / Buyer Responsibility

Buyer assumes full responsibility for product selection, storage, handling, labeling, resale (if applicable), and use. Terp Party is not responsible for damages or issues resulting from improper use, misuse, improper storage, modification, relabeling, unauthorized resale, or use inconsistent with the intended purpose.

Always review instructions and warnings before use. Do not use products if you have sensitivities or allergies to listed ingredients.

 

8) Limitation of Liability

To the maximum extent permitted by law, Terp Party makes no warranties—express or implied—including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or performance.

Under no circumstances shall Terp Party be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to lost profits, business interruption, reputational harm, or lost revenue, arising from or related to any product, order, or use of the Site.

If Terp Party is found liable for any claim, Terp Party’s total liability shall not exceed the amount paid by Buyer for the specific product(s) giving rise to the claim.

 

9) Indemnification

Buyer agrees to defend, indemnify, and hold harmless Terp Party and its owners, affiliates, officers, employees, agents, and representatives from any and all claims, demands, losses, damages, liabilities, penalties, and expenses (including reasonable attorney fees and costs) arising out of or related to:

  • Buyer’s purchase, possession, use, misuse, distribution, resale, labeling, or marketing of products
  • Any alleged defect, failure, or harm associated with the products
  • Buyer’s violation of these Terms or any applicable law
  • Buyer’s acts or omissions, including acts of employees, contractors, agents, or representatives

 

10) Intellectual Property

All Site content, including logos, graphics, product names, images, text, and design elements are the property of Terp Party or its licensors and may not be copied, reproduced, or used without prior written permission.

 

11) Order Refusal / Cancellation

Terp Party reserves the right to refuse, cancel, limit, or delay any order at our sole discretion, including in cases of suspected fraud, payment issues, supply limitations, pricing errors, or failure to complete verification requirements.

 

12) Governing Law

These Terms are governed by the laws of the state/jurisdiction in which Terp Party operates, without regard to conflict of law principles.

 

13) Changes to These Terms

Terp Party may update or modify these Terms at any time. Continued use of the Site or purchase of products after changes are posted constitutes acceptance of the updated Terms.
